Terms of Service

These Terms govern access to Shopmi.ng at and all shop storefronts we host. By creating an account, listing products, or placing an order you agree to them.
1. The service
Shopmi.ng provides software that lets independent sellers publish branded shops and lets buyers discover and pay for products. We are not the seller of record for shop listings unless we expressly say so.
2. Accounts
You must provide accurate information and keep credentials confidential. You are responsible for activity under your account. We may suspend accounts that are abusive, fraudulent, or in breach of these Terms.
3. Sellers
Sellers represent that they have the right to sell listed goods, that descriptions and prices are accurate, and that they will fulfil paid orders with reasonable care. Sellers are responsible for taxes, shipping, returns they offer, and customer service for their goods. Plan limits, trial length, and platform commission apply as configured by the platform administrator.
4. Buyers
Buyers agree to pay for orders they place. Reviews must be honest and based on a paid purchase where the platform requires it. Do not attempt to circumvent checkout or payment verification.
5. Payments
Checkout is processed by Paystack. Successful payment marks an order paid. Chargebacks and payment disputes are handled under Paystack’s rules and these Terms. Unverified shops may be blocked from collecting payment when verification is required.
6. Prohibited conduct
You may not: list illegal or infringing goods; scrape the catalog in a way that harms the service; interfere with other users; upload malware; or impersonate another shop or person.
7. Intellectual property
Sellers retain rights in their logos, product photos, and copy. You grant Shopmi.ng a licence to host and display that content to operate the marketplace. The Shopmi.ng software, design system, and trademarks remain ours.
8. Verification and trust
Verified badges are issued at our discretion after review. They are not a guarantee of product quality. Unverified shops may still operate subject to platform settings.
9. Availability
We aim for continuous service but do not warrant uninterrupted uptime. Features that depend on third parties (payments, email, AI) may be unavailable if those providers fail.
10. Limitation of liability
To the fullest extent permitted by law, Shopmi.ng is not liable for indirect, incidental, or consequential damages, or for losses arising from a seller’s fulfilment, product quality, or statements. Our aggregate liability for a claim relating to the platform is limited to the fees you paid us in the three months before the claim (or one hundred US dollars if you paid none).
11. Indemnity
You will indemnify Shopmi.ng against claims arising from your listings, content, or breach of these Terms.
12. Termination
You may close your account by contacting [email protected]. We may terminate or suspend access for breach. Outstanding orders should still be fulfilled.
13. Governing notes
These Terms are the entire agreement for use of the platform. If a provision is unenforceable, the rest remains in effect. Shop-specific terms published by a seller apply to purchases from that shop in addition to these Terms.
